Terms of Use

BlaBlaEng mobile application · Last updated: 30 October 2026

Please carefully review these Terms of Use (“Terms”) before using the services. These Terms constitute a legally binding agreement between Roman Pieskov (also “we”, “us”, “our”, “Company”), whose full contact and postal details are set out in Section 17 (“Contact and Legal Details”), and you, which governs your use of the BlaBlaEng mobile application (the “App”), our websites, and related services, including all information, text, graphics, software, and communications (the “Content”). The App, websites, Content, and services are collectively referred to as the “Services”.

BlaBlaEng is a service for practising spoken and written English with other people. It matches you with other users for voice calls and text chats. This means that the Services put you in direct contact with other individuals whom we do not employ, vet, or verify. Section 5 (“Community Rules, Reporting and Moderation”) sets out the rules that apply to everyone, how to report or block another user, and what we do when the rules are broken — please read it before you start talking to strangers.

This is a subscription service that automatically renews. We also aim to provide information about our Subscription Policy at or near the point of purchase. Please read these Terms (in particular, Section 8 “Payments, Subscriptions, Coins and Refunds”) and the Subscription Policy carefully before starting a free trial or completing a purchase for the app's auto-renewing subscription services. To avoid being charged, you must affirmatively cancel your subscription or trial at least 24 hours before the end of the free trial or the current subscription period. If you are unsure how to cancel a subscription or a free trial, please visit Apple Support, Google Play Help (or any other relevant app store support pages), or our website depending on where you have purchased your subscription. Deleting the app does not cancel your subscriptions or free trials. You may wish to make a screenshot of this information for your reference.

1. General Terms

1.1 These Terms establish a legally binding contractual relationship between you and us. For this reason, PLEASE READ THE TERMS CAREFULLY BEFORE USING THE SERVICES.

1.2 Please also review our Privacy Policy, which explains what personal data we collect and how we use it. The terms of the Privacy Policy and other supplemental terms, policies, or documents that may be posted on the Services from time to time are hereby expressly incorporated herein by reference.

1.3 We may change these Terms. When we do, we will post the amended Terms on this page and update the “Last updated” date at the top of it. If a change is material — for example, a change to the fees, to your rights, or to the rules in Section 5 — we will give you reasonable advance notice before the change takes effect, by e-mail, by an in-app notice, or in another prominent way. Changes that are required by law or that are made to address a security risk may take effect immediately. If you do not agree to a change, you must stop using the Services and may delete your account (Section 3.7); your continued use of the Services after a change takes effect means that you accept it.

1.4 IF YOU DO NOT AGREE WITH ANY PART OF THESE TERMS, OR IF YOU ARE NOT ELIGIBLE OR AUTHORIZED TO BE BOUND BY THESE TERMS, THEN DO NOT DOWNLOAD THE APP OR OTHERWISE ACCESS OR USE THE SERVICES.

2. What the Services Are, and What They Are Not

2.1 Nature of the Services

The Services are a language-practice tool. They match you with other users so that you can talk to them, and they provide supporting features such as goals, statistics, awards, and progress tracking. The Services are not a language school, a certified course, a tutoring service, a translation service, or a dating service, and they do not provide professional advice of any kind. Any assessment, suggestion, statistic, or other information generated automatically by the App may be inaccurate, incomplete, or out of date, and you are solely responsible for any decision you make on the basis of it.

2.2 No Guarantee of Results

We do not promise, and cannot promise, any particular learning outcome, level of proficiency, exam result, or improvement in your English. We also do not promise that you will be matched with a partner within any particular time, that a partner will be available at all, that a partner will speak at any particular level, or that any conversation will be of any particular quality.

2.3 Other Users Are Not Vetted

We do not employ, screen, interview, background-check, or verify the identity, age, nationality, location, language level, or intentions of any user of the Services. Profile information is supplied by users themselves and may be false. Your interactions with other users are solely between you and them, and you take part in them at your own risk. You should never share financial information, payment details, passwords, identity documents, or your home address with another user, and you should be cautious about sharing any other personal information. If a conversation makes you uncomfortable, end it: you can leave a call at any moment, and you can block and report the other user (Section 5.3).

2.4 Not an Emergency Service

The Services are not a substitute for emergency services and must not be relied on to contact them. If you believe that you or another person is in danger, contact your local emergency number and the appropriate local authorities.

2.5 No Endorsement

We do not endorse, support, or guarantee the accuracy or legitimacy of any user, profile, statement, or user-submitted content within the Services. By using the Services, you understand and agree that, to the extent permitted by applicable law and subject to Section 13, we are not liable for any damages or losses resulting from your use of the Services or from your reliance on any information within them.

3. Your Account

3.1

In order to use the Services, it might be required to create a profile and provide certain information about yourself as prompted by the registration form.

3.2

If you create a profile, you represent and warrant to us that: (i) all required registration information you submit is truthful and accurate; (ii) you will maintain the accuracy of such information; and (iii) your use of the Services does not violate any applicable law or regulation or these Terms. Otherwise, the Services may not operate correctly, and we may not be able to contact you with important notices.

3.3

The Services are not intended to be used by individuals under the age of 16, and you may not create an account if you are under 16. You hereby represent and warrant to us that you meet the foregoing qualification. All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the Services. If you are a minor, you must have your parent or guardian read and agree to these Terms prior to your using the Services. If we learn that an account belongs to a person under 16, we will terminate it and delete the associated data. If you believe that a child is using the Services, please tell us at once using the contact details in Section 17.

3.4

We may suspend or terminate your profile, or your access to the Services, in accordance with Section 5.4 if you breach these Terms, and otherwise on reasonable notice where we discontinue the Services or a part of them.

3.5

You are responsible for maintaining the confidentiality of your profile and login information and are fully responsible for all activities that occur under your profile. You agree to immediately notify us of any unauthorized use, or suspected unauthorized use of your profile or any other breach of security. Except to the extent that the loss is caused by our own failure, we will not be liable for any loss or damage arising from your failure to comply with the above requirements.

3.6

By using the Services, you agree to receive from us certain communications, such as updates on the Services, a periodic e-mail newsletter, or a push notification. You can opt out of non-essential communications by unsubscribing from the email letter or by adjusting your device push preferences. We will always be able to send you service messages that are necessary to operate your account, such as security notices.

3.7 Deleting your account

You may stop using the Services at any time. You can delete your account from within the App, in Settings → Delete account. Deletion removes your profile from the Services and your personal data is handled as described in the Privacy Policy. Please note that: (i) deleting the App from your device does not delete your account and does not cancel a subscription; (ii) a subscription bought through an App Store must be cancelled separately through that App Store (Section 8); and (iii) coins and other virtual items are forfeited on deletion (Section 8.9). Messages you have already sent to another user may remain visible to that user.

4. Access to the Services

4.1

You agree, represent, and warrant that your use of the Services, or any portion thereof, will be consistent with the license, covenants, and restrictions in these Terms and will neither infringe nor violate the rights of any other party or breach any contract or legal duty to any other parties. In addition, you agree that you will comply with all applicable laws, regulations, and ordinances relating to the Services or your use of them, and you will be solely responsible for your own individual violations of any such laws.

4.2

You are solely responsible for obtaining the equipment and telecommunication services necessary to access the Services, and all fees associated therewith (such as computing devices and Internet service provider and airtime charges).

4.3

We may change, improve, or discontinue the Services or any of their features at any time. Where a change materially and adversely affects a feature that you have paid for, we will give you reasonable advance notice and you may cancel your subscription; where mandatory law so requires, you will also be entitled to a refund of the unused part of what you have paid. The Services may also be unavailable from time to time — for example, because of maintenance, updates, a fault, or the failure of a network or a third-party provider — and we do not guarantee uninterrupted availability.

4.4

Your access to and use of the Services is at your own risk. Subject to Section 13, we will have no responsibility for any harm to your computing system, loss of data, or other harm to you or any third party that results from your access to or use of the Services, or from your reliance on any information within them.

4.5

We aim to answer support requests sent to the address in Section 17, but except where mandatory law or an App Store requires otherwise, we do not guarantee any particular response time or level of customer support.

5. Community Rules, Reporting and Moderation

5.1 Zero tolerance

The Services connect you with other people, and everyone is entitled to use them without being abused. We have a zero-tolerance policy for objectionable content and for abusive behaviour towards other users. Content that breaks the rules below will be removed, and the accounts of users who break them will be restricted or terminated. This Section forms part of these Terms, and breaking it is a breach of these Terms.

5.2 Prohibited content and conduct

When using the Services — in a voice call, in a text chat, in your profile, in your username, in your photo, or anywhere else — you must not:

5.3 Reporting and blocking

You can block another user at any time from that user's profile in the App, which stops them from contacting you and prevents you from being matched with them again; the users you have blocked are listed in the App under Blocked users, and you can unblock them there. In the same place you can report a user to us, choosing a reason such as pornography, abuse, fraud, or unwanted dating advances. You can also send us a report by e-mail to the address in Section 17.

If you report content or conduct to us by e-mail, please include enough information for us to act on it: what happened, the username of the person concerned, when it happened, and, where you have it, a description of the content in question, together with a statement that your report is made in good faith and to the best of your knowledge accurate. If you provide us with your e-mail address, we will confirm that we have received your report, decide on it in a timely, diligent, non-arbitrary manner, and tell you what we decided and how you can contest that decision.

5.4 What we may do

Where we have reason to believe that these Terms — and Section 5.2 in particular — have been broken, or where we are required to act by law, we may take one or more of the following measures, choosing the one we consider proportionate to the seriousness of what has happened, whether it has happened before, and the risk of harm to other users: remove or restrict access to the content concerned; issue a warning; limit, suspend, or withdraw access to a feature or to the Services; suspend or terminate your account; and refuse to provide the Services to you in future. We may act without prior notice where there is a risk of harm to a person, a risk to the security of the Services, or a legal requirement to do so; otherwise we will tell you what we did and why.

Where we terminate a paid subscription because you have broken these Terms, you are not entitled to a refund of the remaining period, except to the extent that mandatory law provides otherwise.

5.5 Contesting a decision

If we remove your content, restrict a feature, or suspend or terminate your account, you may contest that decision by writing to us at the address in Section 17 within six months of being informed of it. Tell us what was decided and why you think it was wrong. We will review the decision, we will not decide solely by automated means, and we will inform you of the outcome. If we agree that we were wrong, we will reverse the measure without delay. This does not affect any other remedy available to you under applicable law, including your right to go to court or, where available, to an out-of-court dispute settlement body.

5.6 No obligation to monitor

We do not pre-screen or routinely monitor conversations between users, and we are under no general obligation to do so. Moderation is carried out principally on the basis of reports we receive from users. We may, but are not obliged to, review, remove, or restrict any content or conduct at any time. Nothing in this Section makes us the author of, or responsible for, content created by users.

5.7 Law enforcement

We may preserve and disclose information about an account and its activity to the competent authorities where we believe in good faith that this is required by law, or that it is necessary to prevent a risk to the life or safety of a person, or to prevent or investigate the sexual exploitation of a child, fraud, or another crime.

6. Intellectual Property and User Content

6.1

You acknowledge that all the text, images, marks, logos, compilations (meaning the collection, arrangement, and assembly of information), data, other content, software, and materials displayed on the Services or used by us, excluding any User Content (as defined below), are proprietary to us or to third parties.

6.2

We expressly reserve all rights, including all intellectual property rights, in all of the foregoing, and except as expressly permitted by these Terms or by mandatory applicable law, any use, redistribution, sale, decompilation, reverse engineering, disassembly, translation, or other exploitation of them is strictly prohibited. The provision of the Services does not transfer to you or any third party any rights, title, or interest in or to such intellectual property rights.

6.3

The information you submit to us as part of your registration, and any data, text, image, audio, and other material that you may submit, post, send, or transmit through the Services (“User Content”) remain your intellectual property, and we do not claim any ownership of the copyright or other proprietary rights in it. You are responsible for your User Content and you represent that you have the right to submit it and that it does not break Section 5.2.

6.4

You grant us a non-exclusive, worldwide, royalty-free licence to host, store, copy, transmit, display, and otherwise use your User Content solely to the extent necessary to operate, provide, secure, and support the Services — for example, to deliver your messages to the user you are chatting with, to show your profile to a user you have been matched with, to keep backups, and to enforce Section 5. This licence does not permit us to publish your private communications, to make your User Content available to the public, or to use it for any other purpose, and it is not perpetual: it ends when you delete the User Content or your account, save that (i) we may retain backup copies for a limited period, (ii) content that other users have already received may remain available to them, and (iii) we may retain what we must keep in order to comply with a legal obligation, to establish or defend a legal claim, or to enforce these Terms, in each case for no longer than is necessary and as described in the Privacy Policy. Nothing in this Section limits your rights under data protection law, including your right to erasure.

6.5

If you send us a suggestion, idea, or other feedback about the Services, we may use it without any obligation to you and without any restriction or compensation. This does not apply to any User Content.

6.6

Subject to these Terms, we grant you a non-transferable, non-exclusive, revocable license (without the right to sublicense) to (i) use the Services solely for your personal, non-commercial purposes; and (ii) install and use the App solely on a mobile device that you own or control and solely for your personal, non-commercial purposes. Where you obtained the App from the Apple App Store, this license is further limited as set out in Section 7.6(b).

7. App Stores, Third-Party Ads, Other Users

7.1

You acknowledge and agree that the availability of the app is dependent on the third party from which you received the app, e.g., the Apple App Store, Google Play Market, and/or other app stores (collectively, "App Stores" and each, an "App Store").

7.2

You agree to pay all fees charged by the App Stores in connection with the app. You agree to comply with, and your license to use the app is conditioned upon your compliance with, all applicable agreements, terms of use, and other policies of the App Stores, and of any other third party whose terms apply to your use of the app.

7.3

The Services are supported by advertising and may contain links to third party websites or resources and advertisements for third parties (collectively, "Third-Party Ads"). Such Third-Party Ads are not under our control and we are not responsible for any Third-Party Ads. We provide these Third-Party Ads only as a convenience and do not review, approve, monitor, endorse, warrant, or make any representations with respect to Third-Party Ads. Advertisements and other information provided by Third-Party Ads may not be wholly accurate. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources. When you link to a third-party website, the applicable service provider's terms and policies, including privacy and data gathering practices, govern. You should make whatever investigation you feel necessary or appropriate before proceeding with any transaction with any third party. Your transactions and other dealings with Third-Party Ads, including payment and delivery of related goods or services, are solely between you and such merchant or advertiser. How advertising affects your personal data, and the choices you have about personalised advertising, are described in the Privacy Policy.

7.4

Each user of the Services is solely responsible for any and all of his or her User Content. Because we do not control the User Content, you acknowledge and agree that, subject to Section 5 and Section 13, we are not responsible for any User Content and we make no guarantees regarding the accuracy, currency, suitability, or quality of any User Content. Your interactions with other Services users are solely between you and such user. If there is a dispute between you and any Services user, we are under no obligation to become involved, although we will act on reports under Section 5.

7.5

To the maximum extent permitted by applicable law, you release us, our officers, employees, agents, and successors from claims, demands, losses, damages, rights, claims, and actions of any kind arising from any interactions with or conduct of any App Store, any other Services users, or any Third-Party Ads. Nothing in this Section releases us from liability that cannot be released under the law that applies to you, including the liability described in Section 13.

7.6 Additional terms that apply if you obtained the App from the Apple App Store

The following applies if you downloaded the App from the Apple App Store, and prevails over anything to the contrary elsewhere in these Terms:

7.7 Google Play

If you downloaded the App from Google Play, you acknowledge that these Terms are concluded between you and us only, and not with Google; that Google is not responsible for the App or its content; and that your use of Google Play is governed by Google's own terms. Google is not a party to these Terms and has no obligation to provide support for the App.

8. Payments, Subscriptions, Coins and Refunds

8.1

The app is free to download. Certain features of the Services are offered for a fee, as an auto-renewing subscription whose price and billing interval are disclosed to you before you purchase it (the “Purchase”). All Purchases are made through the App Store from which you obtained the app, and are processed by that App Store: we do not receive or store your payment card details.

8.2

To the maximum extent permitted by applicable laws, we may change Purchase fees at any time. We will give you reasonable notice of any such pricing changes by posting the new prices on or through the app and/or by sending you an e-mail notification, or in another prominent way. A price change never applies to a subscription period you have already paid for. If you do not wish to pay the new fees, you can cancel the applicable subscription prior to the change going into effect or/and abstain from pre-paying for access to the Services.

8.3

You authorize the App Stores to charge the applicable fees to the payment method that you have registered with them.

8.4

By signing up for certain subscriptions, you agree that your subscription may be automatically renewed. Unless you cancel your subscription, you authorize us and the App Stores to charge you for the renewal term. The period of auto-renewal will be the same as your initial subscription period unless otherwise disclosed to you on the Services. The renewal rate will be no more than the rate for the immediately prior subscription period, excluding any promotional and discount pricing, unless we notify you of a rate change prior to your auto-renewal. You must cancel your subscription in accordance with the cancellation procedures disclosed to you for the particular subscription; on both Apple and Google devices this is done in the settings of the App Store account, not in the app. Except where mandatory law provides otherwise, we will not refund fees that have already accrued and will not prorate fees for a cancelled subscription.

8.5

We may offer a trial subscription for the Services. A trial provides you access to the Services or a part of the Services for a period of time, with details specified when you sign up for the offer. Unless you cancel before the end of the free trial, or unless otherwise stated, your access to the Services will automatically continue and you will be billed the applicable fees for the Services. It is ultimately your responsibility to know when the free trial will end. We reserve the right, in our absolute discretion, to modify or terminate any free trial offer or your access to the Services during the free trial, on notice to you and without affecting any period you have already paid for. We reserve the right to limit your ability to take advantage of multiple free trials.

8.6

The Services and your rights to use them expire at the end of the paid period of your subscription. If you do not pay the fees or charges due, we may make reasonable efforts to notify you and resolve the issue; however, we reserve the right to disable or terminate your access to the paid features of the Services.

8.7

Subscriptions purchased via an App Store are subject to that App Store's refund policies, and the refund is granted by the App Store rather than by us. You will have to contact the App Store support. In such cases, we may provide certain data (e.g., your subscription status, account activity, and usage data) to the App Store to assist in processing your refund request in a transparent and fair way. By using our Services, purchasing subscriptions via App Stores, and submitting a refund request through these platforms, you expressly consent to the sharing of the necessary account and usage data with the relevant App Store for this purpose. This does not affect any statutory right you may have against us, and if you have such a right you may exercise it by contacting us at the address in Section 17.

8.8

Save as set out in this Section 8 and except to the extent required by mandatory provisions of the applicable law, a Purchase is final and non-refundable once it has been made. We may also provide refunds at our own discretion and subject to our policies that may be published from time to time.

Note for EU residents: If you are an EU user, you have the right to withdraw from the agreement for the purchase of digital content without charge and without giving any reason within fourteen (14) days from the date of such agreement conclusion. The withdrawal right does not apply if the performance of the agreement has begun with your prior express consent and your acknowledgment that you thereby lose your right of withdrawal. YOU HEREBY EXPRESSLY CONSENT TO THE IMMEDIATE PERFORMANCE OF THE AGREEMENT AND ACKNOWLEDGE THAT YOU WILL LOSE YOUR RIGHT OF WITHDRAWAL FROM THE AGREEMENT ONCE OUR SERVERS VALIDATE YOUR PURCHASE AND THE APPLICABLE PURCHASE IS SUCCESSFULLY DELIVERED TO YOU. Therefore, you will not be eligible for a refund, unless the digital content is defective.

8.9 Coins and other virtual items

The Services include coins, a virtual item used to unlock certain in-app actions. Coins are earned inside the app — for example, by watching a rewarded advertisement or by completing an in-app goal — and are not sold by us for money.

9. User Representations and Restrictions

9.1

By using the Services, you represent and warrant that:

9.2

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to refuse any and all current or future use of the Services (or any portion thereof).

9.3

You may not access or use the Services for any purpose other than that for which we make the Services available. The Services may not be used in connection with any commercial endeavors except those that are specifically authorized or approved by us.

9.4

In addition to the community rules in Section 5.2, which apply to how you behave towards other people, you agree not to:

Nothing in these Terms restricts your right to describe your experience of the Services honestly, including in a public review, a rating, or a complaint to a public authority.

10. Copyright Complaints

We respect the intellectual property rights of others and expect our users to do the same. If you believe in good faith that content available through the Services infringes your copyright, please send a notice to admin@blablaeng.com, with the subject line “Copyright notice”, including: (i) your physical or electronic signature; (ii) identification of the copyrighted work you claim has been infringed; (iii) identification of the material you claim is infringing and information reasonably sufficient to let us locate it; (iv) your contact details; (v) a statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law; and (vi) a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on the owner's behalf.

We will review a complete notice and remove or disable access to the material where appropriate. If your content was removed and you believe this was a mistake, you may send us a counter-notice at the same address, and you may also contest the decision under Section 5.5. We terminate the accounts of repeat infringers in appropriate circumstances. Please note that a person who knowingly misrepresents that material is infringing may be liable for damages.

11. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold us, any of our officers, directors, employees, and agents and our affiliated and related entities, harmless from and against any third-party claims, disputes, costs, losses, liabilities, damages, expenses, and judgments, including reasonable legal and accounting fees, arising out of or in any way connected with (a) your User Content, (b) your breach of these Terms, or (c) your violation of any law or of the rights of a third party. We will notify you of any such claim within a reasonable time, will not settle it without your consent (such consent not to be unreasonably withheld), and will give you reasonable assistance in defending it at your expense. This Section does not apply to the extent that the claim results from our own act or omission, and it does not apply to you at all if and to the extent that mandatory consumer protection law in your country of residence prohibits it.

12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND. WITHOUT LIMITING THE FOREGOING, WE EXPLICITLY DISCLAIM ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. We make no warranty that the Services will meet your requirements or be available on an uninterrupted, secure, or error-free basis. We make no warranty regarding the quality, accuracy, timeliness, truthfulness, completeness, or reliability of any information or content on the Services. YOUR USE OF THE SERVICES IS AT YOUR OWN RISK.

Consumers: some jurisdictions do not allow the exclusion of implied warranties or of certain statutory guarantees, so some or all of the exclusions above may not apply to you. Nothing in these Terms excludes or limits the rights you have as a consumer under the mandatory law of your country of residence, including, for users in the European Union, your rights in respect of digital content and digital services that is not in conformity with the contract.

13. Limitation of Liability

Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; gross negligence or wilful misconduct; or any other liability that cannot be excluded or limited under the law that applies to you. The limitations below apply only to the extent that the applicable law permits them.

SUBJECT TO THE PARAGRAPH ABOVE AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER WE NOR OUR SERVICE PROVIDERS INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE SERVICES WILL BE LIABLE FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, OR DAMAGES FOR LOST PROFITS, LOST REVENUES, LOST SAVINGS, LOST BUSINESS OPPORTUNITY, LOSS OF DATA OR GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, OR SYSTEM FAILURE OR THE COST OF SUBSTITUTE SERVICES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE OR OUR SERVICE PROVIDERS HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, EVEN IF A LIMITED REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

SUBJECT TO THE FIRST PARAGRAPH OF THIS SECTION AND TO THE MAXIMUM EXTENT PERMITTED BY THE LAW OF THE APPLICABLE JURISDICTION, IN NO EVENT WILL OUR TOTAL LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE THE SERVICES EXCEED THE GREATER OF THE AMOUNTS YOU HAVE PAID OR ARE PAYABLE BY YOU TO US FOR USE OF THE SERVICES IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY AND ONE HUNDRED DOLLARS ($100).

THE EXCLUSIONS AND LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN US AND YOU.

14. International Use

We make no representation that the Services are accessible, appropriate, or legally available for use in your jurisdiction, and accessing and using the Services is prohibited from territories where doing so would be illegal. You access the Services at your own initiative and are responsible for compliance with local laws.

15. Governing Law and Disputes

The laws of Ukraine, excluding its conflicts of law rules, shall govern these Terms and your use of the Services. If you are a consumer, this choice of law does not deprive you of the protection afforded to you by provisions that cannot be derogated from by agreement under the law of the country in which you habitually reside, and you may bring proceedings against us in the courts of that country.

15.1 Informal resolution first

If you have any concern or dispute about the Services, you agree to try first to resolve it informally by contacting us at the address in Section 17. We will try to resolve it with you within 30 days. This does not prevent you from going to court or to a competent authority at any time.

15.2 Consumers in the European Union and the United Kingdom

If you are an EU or UK consumer, you benefit from any mandatory provisions of the law of the country in which you reside, and nothing in these Terms affects them. You may also be entitled to bring your complaint to the consumer protection authority of your country or, where one is available and competent, to an out-of-court dispute resolution body.

15.3 United States Federal Government End Use Provisions

If you are a U.S. federal government end user, our Services are a "Commercial Item" as that term is defined at 48 C.F.R. §2.101.

16. Miscellaneous

16.1

No delay or omission by us in exercising any of our rights occurring upon any noncompliance or default by you with respect to these Terms will impair any such right or be construed to be a waiver thereof, and a waiver by us of any of the covenants, conditions, or agreements to be performed by you will not be construed to be a waiver of any succeeding breach thereof or of any other covenant, condition, or agreement hereof contained.

16.2

If any provision of these Terms is found to be invalid or unenforceable, then these Terms will remain in full force and effect and will be reformed to be valid and enforceable while reflecting the intent of the parties to the greatest extent permitted by law.

16.3

Except as otherwise expressly provided herein, these Terms set forth the entire agreement between you and us regarding its subject matter, and supersede all prior promises, agreements, or representations, whether written or oral, regarding such subject matter.

16.4

We may transfer or assign our rights and obligations under these Terms to another person, including by novation, as part of a merger, acquisition, reorganisation, or sale of all or part of our business, provided that the transfer does not reduce the rights you have under these Terms. We will notify you of any such transfer by e-mail or by a notice in the app before it takes effect, and if you do not agree to it you may delete your account. You may not assign or transfer your rights under these Terms, or your account, to anyone else.

16.5

All information communicated on the Services is considered an electronic communication. When you communicate with us through or on the Services or via other forms of electronic media, such as e-mail, you are communicating with us electronically. You agree that we may communicate electronically with you and that such communications, as well as notices, disclosures, agreements, and other communications that we provide to you electronically, are equivalent to communications in writing and shall have the same force and effect as if they were in writing and signed by the party sending the communication. You further acknowledge and agree that by clicking on a button labeled "SUBMIT", "CONTINUE", "REGISTER", "I AGREE" or similar links or buttons, you are submitting a legally binding electronic signature and are entering into a legally binding contract. You acknowledge that your electronic submissions constitute your agreement and intent to be bound by these Terms. YOU HEREBY AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS, AND OTHER RECORDS AND TO ELECTRONIC DELIVERY OF NOTICES, POLICIES, AND RECORDS OF TRANSACTIONS INITIATED OR COMPLETED THROUGH THE SERVICES.

16.6

In no event shall we be liable for any failure to comply with these Terms to the extent that such failure arises from factors outside our reasonable control.

16.7

Except for the App Stores as described in Section 7.6(i), no person other than you and us has any right to enforce any of these Terms.

17. Contact and Legal Details

The Services are provided by:

The Services themselves — the App, the servers behind it, and everything these Terms govern — are ours wherever you obtained the App. Distribution is separate: each store identifies its own trader on the App's page and displays that trader's contact details there. On both the App Store and Google Play that trader is Roman Pieskov, at the address above (Google Play shows the legal name Pieskov Roman Petrovych and, until October 2026, listed the App under the developer name Rona Mobile Solutions). This does not change who you are contracting with under these Terms, or who answers for the Services.

The e-mail address above is the point of contact for all purposes under these Terms, including notices, questions and complaints about the Services or about a Purchase, reports under Section 5.3, requests to contest a decision under Section 5.5, and copyright notices under Section 10. We answer in English, whichever store you used.

I HAVE READ THESE TERMS AND AGREE TO ALL OF THE PROVISIONS CONTAINED ABOVE.
